Off-Road Use Only

Products sold by IRL LLC are high-performance aftermarket automotive components intended primarily for off-road, racing, competition, exhibition, or closed-course use only, unless expressly identified in writing as legal for street use or emissions compliant.

Many products offered by IRL LLC are not certified for use on public roads or highways and may not comply with applicable federal, state, provincial, or local emissions laws or motor vehicle regulations, including, without limitation, regulations enforced by the United States Environmental Protection Agency ("EPA"), the California Air Resources Board ("CARB"), or other governmental authorities.

Customer Responsibility

By purchasing, installing, possessing, or using any product sold by IRL LLC, the customer acknowledges and agrees that they are solely responsible for determining whether the product is legal for installation and use on their vehicle under all applicable federal, state, provincial, and local laws, regulations, emissions requirements, inspection requirements, registration requirements, and vehicle codes.

The customer further acknowledges that products not specifically identified by IRL LLC in writing as emissions compliant, street legal, or covered by a valid California Air Resources Board (CARB) Executive Order ("EO") are intended solely for vehicles operated exclusively in off-road, racing, competition, or closed-course environments.

IRL LLC makes no representation, warranty, or guarantee that any product may be legally installed or operated on a street-driven or emissions-controlled vehicle unless expressly stated in writing.

Limitation of Liability

To the fullest extent permitted by applicable law, IRL LLC, together with its owners, officers, directors, members, managers, employees, contractors, agents, distributors, affiliates, successors, and assigns, shall not be liable for any fines, penalties, citations, registration issues, inspection failures, emissions violations, governmental enforcement actions, property damage, vehicle damage, labor expenses, towing charges, storage fees, warranty denials, lost profits, lost income, or any direct, indirect, incidental, consequential, exemplary, punitive, or special damages arising from or relating to the purchase, installation, possession, transportation, resale, misuse, or use of any product sold by IRL LLC.

Indemnification

The customer agrees to indemnify, defend, and hold harmless IRL LLC and its owners, officers, directors, members, managers, employees, contractors, agents, distributors, affiliates, successors, and assigns from and against any and all claims, liabilities, losses, damages, fines, penalties, judgments, settlements, governmental actions, costs, expenses, and reasonable attorneys' fees arising out of or relating to:

• The installation or use of any product sold by IRL LLC;
• Any violation of applicable emissions, environmental, vehicle, or transportation laws;
• Any modification or operation of a vehicle equipped with products sold by IRL LLC; or
• The customer's failure to comply with applicable federal, state, provincial, or local laws or regulations.

California Notice

Certain products sold by IRL LLC are legal for use only on competition racing vehicles as defined under applicable California law and are not legal for installation or operation on any other motor vehicle unless expressly identified as emissions compliant.

California Health and Safety Code § 39048 defines a "racing vehicle" as a competition vehicle that is not operated on public highways. Competition-only vehicles must be operated exclusively on closed-course racing facilities and transported to and from racing events by trailer or other lawful means. They may not be driven on public roads unless otherwise permitted by law.

Use of competition-only products on emissions-controlled or street-driven vehicles may subject the owner or operator to civil penalties, fines, failed emissions inspections, registration consequences, or other enforcement actions under applicable federal, state, or local law. Such use may also void manufacturer warranties applicable to the vehicle or affected components.

Acceptance of Terms

By purchasing, possessing, installing, or using any product sold by IRL LLC, the customer acknowledges that they have read, understood, and agree to this Off-Road Use, Emissions, and Legal Compliance Disclaimer and accept full responsibility for complying with all applicable laws and regulations governing the purchase, installation, and use of aftermarket automotive products.
